Arrest records obtained from the DCJS are not public records and can only be requested by the subject of the record, employers and law enforcement agencies. How to Get an Arrest Record Expunged in Richmond County

Expungement is a legal process individuals can use to permanently remove information about their arrests and convictions from publicly accessible records. Unlike most US states, New York and, by extension, Richmond County do not have an expungement statute and instead rely on the sealing of arrest records to remove them from general public access.   • Draft and submit an expungement petition: The next step is to submit a sealing petition to the Richmond County court where the case was heard. Although they can frequently be submitted simultaneously, each charge needs a separate petition.
  • Participate in a Court Case: The court will either grant the petition or schedule a hearing. A judge may take into account the length of time since the offence, efforts at rehabilitation, such as work or school, any recurrent offences, and the potential effects of expungement on public safety.

A hearing is necessary in certain circumstances, particularly if an agency or prosecutor disagrees. To decide whether expungement is appropriate, the court will consider the petition, any objections, and the applicant's criminal record during the hearing.
